These Terms of Service ("Terms") govern your access to and use of the KOSI mobile application and dashboard website (collectively, the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Service.
2. Eligibility
2.1 Age Requirements:
- Parent/Guardian: Must be at least 18 years old to create an account
- Child Users: App is designed for children ages 5-8
- Parental Consent: Required for all child use
2.2 Account Registration:
- Parents must create an account via dashboard.kosiapp.com
- One parent account can manage multiple child devices
- Parents are responsible for maintaining account security
3. Service Description
KOSI provides:
- AI-powered interactive storytelling for children
- Voice-based story requests using speech recognition
- Text-to-speech narration in multiple languages
- Optional voice cloning feature for personalized narration
- Parental dashboard for monitoring and control
4. Parental Responsibilities
As a parent/guardian, you agree to:
- Supervise your child's use of the app
- Review stories and content generated
- Maintain control of your dashboard login credentials
- Monitor subscription and payment information
- Decide whether to enable optional features (e.g., voice cloning)
5. User Conduct
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to bypass security measures or access restrictions
- Reverse engineer, decompile, or disassemble the app
- Use automated systems (bots) to access the Service
- Share your account credentials with unauthorized persons
- Upload malicious content or attempt to harm the Service
6. Subscriptions and Payments
6.1 Free Tier:
- Limited access to story generation
- Pre-recorded classic stories available
- No payment required
6.2 Premium Subscription:
- Unlimited AI-generated stories
- Voice cloning feature
- Multiple language support
- Priority support
6.3 Billing:
- Subscriptions are billed through Stripe
- Monthly or annual billing available
- Automatic renewal unless cancelled
- All prices displayed include applicable taxes
6.4 Cancellation:
- Cancel anytime through dashboard.kosiapp.com
- Access continues until end of current billing period
- No refunds for partial months
6.5 Refund Policy:
- 7-day money-back guarantee for new subscriptions
- Contact support@kosiapp.com for refund requests
- Refunds processed within 5-7 business days
7. Intellectual Property
7.1 Our Content:
All content, features, and functionality of KOSI (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by KOSI and protected by copyright, trademark, and other intellectual property laws.
7.2 User-Generated Content:
- Voice recordings: You retain ownership of voice recordings you upload
- License: By uploading, you grant KOSI a license to use recordings solely for providing the voice cloning feature
- AI-generated stories: Stories are generated by AI and not copyrightable; you may use them for personal, non-commercial purposes
8. Content Moderation
🛡️ Child Safety: KOSI uses AI content moderation to ensure age-appropriate content. However, parents should supervise usage.
- Inappropriate requests are automatically filtered
- Stories are generated with child-safe guidelines
- Parents can report content concerns via dashboard
- We reserve the right to review and moderate content
9. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key points:
- We comply with COPPA and GDPR
- Children's data is protected with enhanced security
- Parents have full control over data collection
- Data can be deleted at any time
10. Third-Party Services
KOSI uses third-party services:
- OpenAI: Story generation
- ElevenLabs: Text-to-speech and voice cloning
- Supabase: Data storage
- Stripe: Payment processing
These services have their own terms and privacy policies. We are not responsible for their practices.
11. Disclaimers
11.1 Service "As Is":
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
11.2 AI-Generated Content:
- Stories are generated by AI and may contain inaccuracies
- We do not guarantee educational or factual accuracy
- Parents should review content for appropriateness
11.3 Availability:
- Service may be interrupted for maintenance
- We do not guarantee 100% uptime
- Features may be modified or discontinued
12. Limitation of Liability
To the maximum extent permitted by law:
- KOSI shall not be liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you in the past 12 months
- We are not liable for third-party services or content
13. Indemnification
You agree to indemnify and hold KOSI harmless from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your violation of any law or rights of a third party
- Your use or misuse of the Service
14. Termination
14.1 By You:
- Delete your account through dashboard.kosiapp.com
- Uninstall the app from child's device
- All data will be deleted per our retention policy
14.2 By Us:
We may terminate or suspend your account if:
- You violate these Terms
- You engage in fraudulent activity
- Your payment method fails
- Required by law
15. Changes to Terms
We may update these Terms from time to time. We will notify you via:
- Email to registered address (30 days notice)
- In-app notification
- Updated "Effective Date" on this page
Continued use after changes constitutes acceptance of new Terms.
16. Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Bucharest, Romania.
17. Dispute Resolution
17.1 Informal Resolution:
Before filing a claim, you agree to contact us at support@kosiapp.com to attempt informal resolution.
17.2 Arbitration:
If informal resolution fails, disputes will be resolved through binding arbitration.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KOSI regarding the Service.
